Vancouver: “Attribution Science,” an important new branch of academic learning, attributes the blame for most of the world’s atmospheric pollution directly to 90 corporations and not to consumers. The research links the demise of earth’s ecosystems, organisms, and inhabitants to the profit marketing strategies of corporations: poisoning of the earth; environmental disasters; harms to and deaths of thousands of people; extinction of natural species; melting of glaciers and sea ice; rise and acidification of the world’s oceans.<br />

<br />
Bundled into these investigations are documents revealing corporations have known for some 60 years that the production and marketing of fossil fuels were going to cumulatively harm the planet and its inhabitants, and that they deceived and misled the public. Academics state that the strategies and techniques used “come straight out of the tobacco industry’s playbook for delaying tobacco control.”<br />

<br />
Can Attribution Science be used to quantify water pollution by companies and how much was enabled by authorities, for example in Alberta, by deregulating, secretly altering historic baseline data and intentionally destroying groundwater protection maps? Questions about foreknowledge and intent similarly apply to the cumulative undertakings of the Canadian Association of Petroleum Producers and the Alberta Energy Regulator regarding fossil fuel development, including escalation of unconventional resources. If experts and upper management promoted and developed geological formations cognizant of the outcomes of their actions, then it not only paints a disturbing and sacrilegious picture but adds a sinister motive behind the harms perpetrated to the citizenry and environment. <br />

Is there any court that will uphold the rule of law and find guilty this malicious intent? Will Attribution Science be enough to void all rulings that order(ed) poisoned families to be settled and gagged, with judges knowing this silencing of the harmed enables the guilty to repeatedly pollute again “down the street?”<br />

"La rivière Richelieu alimente en eau potable quelque 42 municipalités pour un total de près de 250 000 personnes. Aux yeux de l’<a href="https://riviererichelieu.ca/">Association des riverains et amis du Richelieu (ARAR)</a>, la rivière, cette richesse inestimable, est abandonnée à elle-même.<br />
<br />
Fondée en 2017, l’association est préoccupée, entre autres, par la qualité de l’eau, la navigation responsable et la reconnaissance patrimoniale de l’historique rivière. L’entité tient son assemblée annuelle le 23 octobre, à Saint-Charles, et son objectif principal est de représenter l’ensemble de la rivière qui fut, jadis, une voie incontournable pour la circulation des marchandises et des personnes riveraines entre les diverses communautés.<br />
<br />
Plus près dans le temps, plusieurs aiment se souvenir non seulement des baignades et des pêches miraculeuses, mais aussi de la navigation de plaisance à bord d’embarcations plus modestes.<br />
<br />
Aujourd’hui, la situation désespère l’ARAR, en particulier l’indifférence d’une population qui, témoin silencieuse du déclin du Richelieu, semble considérer comme marginale son importance.<br />
<br />
« Nous identifions trois principales menaces contre lesquelles il nous faudrait agir sans délai : les surverses d’eau usées dans la rivière, la toxicité en provenance des exploitations agricoles et la navigation irresponsable par les utilisateurs », met en reflet Pierre-Paul Gareau, secrétaire au conseil d’administration de l’ARAR.<br />
<br />
L’association pointe du doigt le nombre de surverses des eaux usées et identifie une mise à niveau nécessaire des installations municipales. À la suite d’une demande à la Commission d’accès à l’information, les chiffres du ministère de l’Environnement révèlent qu’en 2018, 2 654 surverses ont été dénombrées, soit 20 % de plus que l’année précédente.<br />
<br />
« Les eaux usées de nos usines, commerces et domiciles se retrouvent dans des connecteurs d’égout et sont dirigées soit vers des usines de décantation ou des étangs aérés gérés par nos municipalités. Ces installations ont pour but de décanter ces résidus et de disposer des boues qui en résultent. Ces stations de pompage des eaux usées ne suffisent pas à la tâche en certaines périodes de pluie, de fonte des neiges ou pour toute autre raison. Et la situation s’aggrave avec les nombreux développements immobiliers alors que les infrastructures n’ont déjà pas la capacité de bien traiter les déchets actuels », profile Pierre-Paul Gareau.<br />
<br />
Il survient donc des périodes où les 27 réseaux d’égout qui jalonnent le Richelieu, comprenant 377 ouvrages ou stations, déversent leur trop-plein directement dans la rivière. Toujours selon les chiffres du ministère de l’Environnement, en 2018, 252 de ces ouvrages ont débordé.<br />

« À titre d’exemple, la Municipalité de Saint-Jean-sur-Richelieu a effectué 1225 surverses en 2018, celles de Beloeil et de Saint-Hilaire 526, tandis que 183 surverses provenaient de Saint-Basile-le-Grand et de Saint-Bruno-de-Montarville. Cette dernière ville s’approvisionne en eau potable au fleuve Saint-Laurent et rejette certaines de ses eaux usées dans le Richelieu », décortique M. Gareau<br />
<br />
Selon l’homme de l’ARAR, les résultats de ces déversements dans la rivière restent bien méconnus puisque les usines de filtration chargées de la qualité de l’eau potable ne détecteraient qu’en partie les composants chimiques et pharmaceutiques qui s’y retrouvent.<br />
<br />
« Certes, concernant l’eau que nous buvons, les autorités nous rassurent que les procédés de filtration utilisés (chloration, ozonisation, charbon, etc.) contribuent à sa qualité et à sa non-toxicité. Mais on doit néanmoins s’inquiéter du caractère toxique aggravant des eaux de la rivière, pour sa faune et sa flore, mais aussi pour ses effets sur la qualité à long terme de notre eau quotidienne. Si la source se tarit, les mesures pour nous abreuver devront être de plus en plus sévères », avance l’homme qui milite pour la rivière.<br />
Infrastructures municipales<br />
<br />
Lors des dernières élections provinciales, les candidats et désormais ministres Simon Jolin-Barrette et Jean-François Roberge avaient promis de s’attaquer aux déficiences d’infrastructures municipales.<br />

« Depuis que la CAQ est au pouvoir, rien n’a été fait en ce sens, reproche Pierre-Paul Gareau. Le temps des promesses est déjà révolu; il est temps d’agir. »<br />
<br />

Le mercredi 21 août, un bruit infernal nous a tirés de notre travail, mon conjoint et moi, et poussés à aller voir à l’extérieur ce qui produisait ce vacarme. Sur la route régionale qui passe devant notre maison, deux énormes engins du ministère des Transports du Québec s’avançaient, rasant tout ce qui se trouvait dans le fossé sur une distance de cinq à six mètres de l’accotement.<br />
<br />
En quelques heures, entre mon village et le village voisin, des dizaines, voire des centaines d’arbres qui ne nuisaient en rien à la circulation ni à la visibilité des automobilistes sont tombés. Seulement devant notre maison, dix-sept petits arbres dont les branches n’auraient probablement jamais atteint la route ont été abattus.<br />
<br />
Devant l’ampleur des dégâts, je me suis précipitée pour demander à l’homme qui supervisait les opérations s’il pouvait m’expliquer ce qui se passait. Il m’a répondu que le ministère des Transports procédait à ce type de nettoyage régulièrement et qu’ils avaient le droit de couper sans distinction jusqu’aux poteaux d’Hydro-Québec. Après quoi, voulant me rassurer, car j’étais dans une colère noire, il m’a dit de ne pas m’en faire, que des arbres, il y en avait en masse et qu’il allait toujours en rester…<br />
<br />
Je ne blâme pas cet employé, qui ne faisait que son travail et ne prend probablement pas part aux décisions. Je blâme par contre le ministère des Transports du Québec qui, en maintenant de tels procédés, soutient du même coup une culture de l’indifférence que notre époque ne peut pas se permettre. Je blâme aussi ceux et celles qui établissent les règles qui régissent ce ministère pour leur manque total de discernement et pour s’appuyer sur des normes dont l’exercice est parfois aberrant. Qu’une personne ou une entité administrative ait le droit de faire quelque chose ne l’autorise pas pour autant à user de ce droit aveuglément.<br />
<br />
Depuis des années, des gens préoccupés par le sort que nous faisons à notre environnement nous incitent à planter des arbres, et voilà que l’un de nos plus importants ministères détruit jour après jour les efforts que certains déploient, eux aussi, quotidiennement.<br />
<br />
Je suis d’accord qu’il faut assurer la sécurité routière, mais cet abattage sauvage, exécuté sans aucune forme de jugement, sans évaluation préalable des possibles dangers causés par les cerisiers, peupliers, jeunes bouleaux et autres espèces qui poussent près de nos routes, est totalement inutile.<br />
<br />
Ces façons de charcuter impunément un environnement riche en plantes ligneuses et protégeant une faune abondante sont non seulement révoltantes, mais coûteuses. Pourquoi n’utiliserait-on pas plutôt l’argent dépensé ici en pure perte pour débarrasser nos fossés des ordures qui s’y accumulent et polluent les boisés et les cours d’eau qui longent certains axes routiers ?<br />
<br />
Si, au moins, on utilisait le bois coupé pour en faire un combustible quelconque. Mais non, tout ce qui a été éliminé reste au sol et est destiné à pourrir sur place, parmi les déchets que personne ne ramasse, sauf quelques imbéciles dans mon genre, qui se promènent avec leurs sacs à ordures pour y entasser les dizaines de contenants de plastique, de métal, de styromousse, et j’en passe, qui aboutissent on ne sait comment dans la nature.<br />
<br />
Si, au moins, on coupait proprement. Mais non, on arrache, on déchire, on laisse sur place des troncs déchiquetés, des branches à moitié coupées qui se balancent sur des chicots d’arbres ou sur des arbres fendus par le milieu.<br />
<br />
Si, au moins, plutôt que de passer le décor à la tronçonneuse, on procédait à de la coupe sélective, fondée sur une évaluation de la dangerosité de certains arbres et sur l’usage que l’on peut faire du bois coupé. Mais non, on rase.<br />
<br />
On me répondra probablement ici à coups de chiffres, mais un entretien intelligent et responsable de nos bords de route coûterait assurément moins cher que ce type de massacre.<br />
<br />
Ces méthodes de nettoyage à blanc, si je peux dire, sont inadmissibles, et j’espère sincèrement que quelques personnes avisées, au ministère des Transports du Québec, se pencheront sur l’absurdité que je dénonce, car des arbres, il y en aura encore pour un certain temps, bien sûr, mais peut-être pas pour aussi longtemps et en aussi grand nombre que nous voulons le croire.<br />

Elle attendait que sa firme d`avocats lui donne contrôle de son site Web, dit-elle. Son site Web est une archive de sa poursuite ainsi qu`un témoignage des impacts politiques, légaux et écologiques de la force brute de la technologie de la fracturation hydraulique. <br />

(Son avocat) Klippenstein se bat contre une déclaration de principes adopté dernièrement par la Law Society of Ontario qui oblige les firmes d`avocats à "promouvoir l`égalité, la diversité et l`inclusion" et faire une "auto-évaluation d`inclusion annuelle".<br />

Les avocats "seront de plus en plus jugés selon leur idéologie, la couleur de la peau et les chromosomes sexuels plutôt que par leur compétences, leur effort et contributions professionnelles" selon ce règlement, argumente-t-il.<br />

Toutefois, les partisans pour ces nouveaux règlements disent que les critiques de Klippenstein et les autres démontrent comment ces règlements sont rudement nécessaires.<br />

Klippenstein a aussi donné une autre raison pour avoir laissé tomber la poursuite, écrivant dans un courriel envoyé au Tyee qu`il "était de plus en plus préoccupé par l`opinion de Mme Ernst sur la viabilité de sa propre poursuite, en particulier à cause de ses opinions de plus en plus critiques envers le système judiciaire, et des avocats qui sont dans ce système, au point tel que j`ai pensé qu`il n`était plus viable pour nous de la représenter à l`avenir."<br />

Ernst affirme qu`elle avait complètement expliqué ses opinions à Klippenstein en 2007 pendant qu`elle se cherchait des avocats potentiels (pour la représenter). Sa position à ce sujet n`a jamais changé, ajoute-t-elle.<br />

Une chronologie de Jessica<br />

La poursuite de Jessica Ernst contre l`industrie de la fracturation hydraulique en Alberta et ses régulateurs démontre brutalement comment le système judiciaire du Canada est devenue lent.<br />

<br />
1er mai 1998: Jessica s`installe sur une petite propriété rurale à Rosebud, en Alberta. Son puits lui fournit une eau douce, de grande qualité. Les tests sur l`eau indique qu`il n`y a pas de gaz dedans.<br />
<br />
<br />
2001: Encana commence un projet expérimental de fracturation hydraulique de faible profondeur pour extraire le gaz naturel autour de Rosebud, sans consulter la communauté ni les propriétaires terriens, violant ainsi les exigences du régulateur des sources énergétiques de l`Alberta.<br />
<br />
<br />
14 février 2004: Encana fore et ensuite fracture hydrauliquement dans l`aquifère de l`eau potable qui alimente le puits de Jessica, ceux d`une douzaine de familles et le hameau de Rosebud.<br />

<br />
Janvier 2005: Une explosion dans le château d`eau de Rosebud blesse sérieusement un employé de Wheatland County. On a rapporté qu`une enquête avait déterminé que l`explosion avait été apparemment causée par "une accumulation de gaz".<br />

24 novembre 2005: Le régulateur de l`énergie (du nom d`alors de Energy Resources Conservation Board et maintenant Alberta Energy Regulator) envoie une lettre à Jessica. La lettre qualifie ses critiques du régulateur comme étant une "menace criminelle" et déclare qu`il cesse toute communication avec elle.<br />

6 décembre 2005: Jessica envoie une lettre demandant des éclaircissements sur la décision du régulateur de couper toute communication (avec elle). Sa lettre lui revient non ouverte.<br />

8 Juin 2006: L`avocat du régulateur Rick McKee questionne Jessica durant une conversation enregistrée avec témoin. McKee admet que le régulateur ne l`a jamais considérée comme une "menace criminelle" mais comme une critique indésirable. Il demande aussi à Jessica ce que çà prendrait pour qu`elle s`en aille de l`Alberta. Jessica répond qu`elle partira joyeusement de l`Alberta aussitôt que le régulateur fasse son travail (correctement).<br />

Décembre 2007: Jessica engage l`avocat Murray Klippenstein et intente un procès de $33 million contre Encana, le ministère de l`environnement de l`Alberta et le Energy Resources Conservation Board (un peu comme notre Régie de l`Énergie au Québec), alléguant que la contamination de l`eau souterraine a été causée par les fracturations hydrauliques de faible profondeur dans les puits de méthane de houille au coeur de l`Alberta.<br />

<b>Another Setback in Landmark Fracking Case as Lawyers Pull Out</b><br />

Jessica Ernst’s 12-year legal battle over water contamination no nearer resolution.<br />

Jessica Ernst has spent 12 years and $400,000 pursuing a lawsuit against the Alberta fracking industry and its regulator.<br />
<br />
Now her Ontario lawyer has let go most of his staff and given up the case.<br />
<br />
“I was shocked and felt terribly betrayed,” said Ernst. “The legal system doesn’t want ordinary people in it. They don’t want citizens who will not gag and settle out of court for money so corporations and government can continue their abuse.”<br />
<br />
In 2007, Ernst, then an oil patch consultant with her own thriving business, sued the Alberta government, Alberta’s energy regulator and Encana. She alleged her well water had been contaminated by Encana’s fracking and government agencies had failed to investigate the problems.<br />
<br />
For more than a decade the case has been bogged down by legal wrangling, legal posturing and constant delays. Three different judges have been involved.<br />
<br />
The process included a two-year detour to the Supreme Court of Canada, which ruled that Ernst could not sue the regulator because it is given immunity by provincial legislation. The lawsuits against the provincial government and Encana remain before the courts.<br />
<br />
And still no evidence has been heard on the actual merits of the case.<br />
<br />
Ernst was represented by high-profile lawyer Murray Klippenstein. He told The Tyee in an email that “major changes in the political climate of the legal profession in Ontario” made it “no longer feasible for me to continue my law firm. That was heartbreaking to me, for many reasons.”<br />
<br />
Klippenstein is fighting against a recently adopted Law Society of Ontario statement of principles that obliges law firms to “promote equality, diversity and inclusion” and perform annual “inclusion self-assessments.”<br />
<br />
Lawyers “will increasingly be judged more on the basis of ideology, skin colour and sex chromosomes than by their competence, skills, effort and professional contributions” under the rule, he argued.<br />
<br />
However, advocates for the new rules say criticism from Klippenstein and others showed how badly they are needed.<br />
<br />
Legal scholar Joshua Sealy-Harrington argued that the “forceful opposition” showed the insufficient awareness of systemic discrimination in Canadian legal practice, which has been detailed time and time and time and time again.<br />
<br />
Klippenstein also offered another reason for quitting the case, saying in an email to The Tyee that he “had increasing concerns about Ms. Ernst’s views about the viability of her own lawsuit, in particular because of Ms. Ernst’s highly and increasingly critical views of the legal system, and of the lawyers that were a part of that system, to the point where I thought it was simply no longer viable for us to represent her going forward.”<br />
<br />
Ernst said she fully explained her critical views to Klippenstein in 2007 as she vetted potential lawyers. Those views have never changed, she added.<br />
<br />
“Murray warned me in 2007 that I would need to spend a million dollars and give up 10 to 12 years of my life, to maybe win a few thousand dollars,” said Ernst.<br />
<br />
She said Klippenstein told her that lawsuits like hers were usually settled with a payment and a non-disclosure agreement that silences the person who had sued “because our legal system is set up to make that happen.”<br />
<br />
Ernst said she had always been clear that she would not accept a non-disclosure agreement. The issue of contaminated water goes beyond one household or community and the public needs to be aware, she said.<br />
<br />
Ernst said Klippenstein also warned her that the courts might order her to pay the legal costs of Encana and the other defendants even if she won the lawsuit.<br />
<br />
“I would have to also pay the legal costs of the defendants even if I win but win less than what the defendants offer me to gag,” she said. “Who wouldn’t be bitter?”<br />
<br />
Ernst’s lawsuit claims fracking contaminated the water supply at her homestead near Rosebud, about 110 kilometres east of Calgary. Research has shown fracking, in which companies blast water, chemicals and sand underground to crack rock formations and allow methane to flow, can result in groundwater contamination.<br />
<br />
The suit alleges that Encana was negligent in the fracking of shallow coal seams; that the regulator breached Ernst’s freedoms under the Charter of Rights and Freedoms, and that Alberta Environment performed a problem-plagued investigation in bad faith.<br />
<br />
Even before the lawsuit was launched, Ernst was locked in conflict with the Energy Resources Conservation Board, now the Alberta Energy Regulator. In November 2005, the regulator sent Ernst a letter saying it had told its staff to “avoid any further contact” with her on the grounds that she had criticized the board and made “criminal threats.”<br />
<br />
But in June 2006 Rick McKee, then chief counsel for the regulator, admitted in a taped interview (Liberal MLA David Swann was a witness) that Ernst never presented a security threat to the organization.<br />
<br />
She also sued the regulator for violating her charter rights by falsely branding her a “criminal threat” in 2005.<br />
<br />
The Supreme Court of Canada split ruling on Ernst’s right to sue the energy regulator included a claim by Justice Rosalie Abella that the regulator found Ernst to be a “vexatious litigant,” though no regulator in Alberta has ever described Ernst as such. Four of the other justices commented on Abella’s claim, noting, “We see no basis for our colleague’s characterization.”<br />
<br />
But Ernst has been unsuccessful in having the statement corrected in the judgment, noting it could be used against her in future hearings. The Canadian Judicial Council informed Ernst that it has no policy for correcting errors and that only the Supreme Court can amend or review reasons for its decisions.<br />
<br />
Some legal scholars criticized the Supreme Court decision and said it weakened the Charter of Rights and Freedoms by allowing governments to place regulators above the law.<br />
<br />
Ernst learned Klippenstein was withdrawing from the case last fall, but didn’t share the information until recently. She was waiting until the law firm surrendered control of her website, she said. The website is an archive of her lawsuit as well as a record of the political, legal and ecological impacts of the brute force technology of fracking.<br />
<br />
The Tyee asked Klippenstein why the case has floundered in the justice system for nearly a dozen years.<br />
<br />
“Ms. Ernst’s case was and is an enormously ambitious undertaking, involving numerous highly-complex scientific and legal issues, against a number of very powerful, very well-resourced, and very determined opponents,” he said. “We all knew that from the beginning, and we all knew that it would be an incredibly difficult and lengthy and time-consuming effort to undertake it, and a seriously uphill battle all the way.”<br />
<br />
Klippenstein said he advised Ernst that she now has three options: she can transfer the case to another lawyer; continue with the lawsuit by representing herself; or let Klippenstein wind down the lawsuit “in a way that is most advantageous or least disadvantageous to you.”<br />
<br />
Ernst said that she has rejected the third option.<br />
<br />
“I have always been public and open about my case. But since I have no lawyers, I can’t disclose to The Tyee as much as I would like about my next steps,” she said. “I need to keep those options to myself.”<br />
<br />
Ernst is philosophical about the latest setback.<br />
<br />
“I am a lot less bitter now than I was when I started my lawsuit in 2007,” she said. “I have a wild sense of humour. What I have learned is that Canada’s legal system is a farce.”<br />
<br />
“We don’t have a justice system, but a legal system designed to serve the interests of the powerful and to employ judges and lawyers.”<br />

An Ernst chronology<br />

Jessica’s Ernst’s lawsuit against Alberta’s fracking industry and its regulators provides a blunt view of how slow and protracted Canada’s legal system has become.<br />
<br />
May 1, 1998: Ernst moves to a small rural property in Rosebud, Alberta. Her well produces soft, high-quality water. Water tests state “Gas Present: No.”<br />
<br />
2001: Encana begins an experimental shallow fracturing natural gas project around Rosebud, without consulting with the community or landowners in violation of the Alberta energy regulator’s requirements.<br />
<br />
Feb. 14, 2004: Encana drilled and later hydraulically fractured in the drinking water aquifers supplying Ernst, a dozen families and the Hamlet of Rosebud.<br />
<br />
January 2005: An explosion at the Rosebud water tower seriously injured a Wheatland County worker. It was reported that an investigation determined the explosion was apparently caused by “an accumulation of gases.”<br />
<br />
Nov. 24, 2005: The energy regulator (then the Energy Resources Conservation Board, now the Alberta Energy Regulator) sends a letter to Ernst. It brands her criticisms of the regulator as a “criminal threat” and says it ceases all communication with her.<br />
<br />
Dec. 6, 2005: Ernst sends a letter seeking clarification on the regulator’s decision to cut off communication. It is returned unopened.<br />
<br />
June 8, 2006: Regulator lawyer Rick McKee questions Ernst in a recorded conversation with a witness. McKee admits that the regulator never saw her as “a criminal threat,” but as an unwelcome critic. He also asks Ernst what it will take to get her to leave Alberta. Ernst replies she will gladly leave Alberta as soon as the regulator starts to do its job.<br />
<br />
December 2007: Ernst hires lawyer Murray Klippenstein and files a $33-million lawsuit against Encana, the Alberta environment ministry and the Energy Resources Conservation Board alleging groundwater contamination was caused by the shallow fracking of coalbed methane wells in central Alberta.<br />

Feb. 12, 2009: RCMP officers arrive at Ernst’s home without warrants to ask questions.<br />
<br />
Oct. 24, 2009: Prime minister Stephen Harper announces the appointment of Neil Wittmann as new Alberta chief justice of the Court of Queen’s Bench.<br />

July 19, 2010: The U.S. Congress investigates fracking practices, including the impact on drinking water. Encana is one of the companies questioned.<br />

June 24, 2011: The Harper government appoints Barbara Veldhuis to the Court of Queen’s Bench.<br />

Oct. 1, 2011: UNANIMA International, a U.S. NGO, presents Ernst with a Woman of Courage award in New York City.<br />

April 26, 2012: The first hearing on the lawsuit takes place in the Court of Queen’s Bench in Drumheller. Justice Veldhuis requests a shorter statement of claim and volunteers as case manager. Energy regulator lawyer Glenn Solomon asks that the original statement of claim be removed from the court and public record. The request is denied.<br />

Oct. 1, 2012: Defendants apply to have the case moved to Calgary during a case management call with Justice Veldhuis. Justice Wittmann later accepts the application to move the case to Calgary.<br />
<br />
December 2012: In its legal brief filed with the court, the energy regulator changes its 2005 accusation that Ernst posed a “criminal threat” and described her as being an “eco-terrorist.”<br />
<br />
Jan. 18, 2013: A second court hearing takes place in Calgary, where the courtroom is packed. Ernst refused to accept the change of venue and attends the Drumheller Court House with a witness. Encana does not argue to have the case struck, though the company website states that the case has no merit.<br />
<br />
Feb. 8, 2013: The Harper government promotes Justice Veldhuis to the Alberta Court of Appeal. She advises that ruling on arguments in the Ernst case is “not an option.”<br />
<br />
Feb. 15, 2013: During a case management call, Justice Veldhuis says Justice Wittmann has volunteered to take over the case.<br />
<br />
Sept. 19, 2013: Justice Wittmann, despite not having presided over the original hearing, rules Ernst has a valid Charter of Rights and Freedoms claim but that the regulator is protected by legislation giving it immunity from civil litigation. He dismisses the regulator’s claim that Ernst is an “eco-terrorist” due to “the total absence of evidence.” He denies the Alberta government’s attempts to get the word “contamination” removed from Ernst’s statement of claim.<br />

January 13, 2014: During a case management call, Justice Wittmann grants the Alberta government another chance to try to get Ernst’s case thrown out (at great cost of time and money to her). The hearing is set for April 16, 2014, and the case is moved back to Drumheller, where by law, it belongs.<br />

Feb. 18, 2014: The Alberta government files a brief to strike the lawsuit against it. It argues the government has no duty of care to landowners and immunity. The motion comes three years after the lawsuit was launched.<br />
<br />
March 18, 2014: Ernst responds to the government. Her lawyers argue that the approach taken by Alberta Environment is an abuse of process.<br />
<br />
April 16, 2014: Drumheller Court of Queen’s Bench hears the Alberta government’s application to be removed from the Ernst case. Justice Wittmann orders document exchange between Ernst and Encana.<br />
<br />
Sept. 15, 2014: The Alberta Court of Appeal rules that Alberta’s energy regulator cannot be sued by citizens even if it breaches constitutional rights.<br />

Nov. 10, 2014: Chief Justice Wittmann rules that Alberta Environment can be sued. He orders Alberta Environment to pay Ernst “triple costs,” still less than the legal cost of protecting her case from having been thrown out.<br />

Compelling speech is unconscionable regardless of the principles a person is made to parrot."<br />

How noble, putting his business on the line to defend some "freedoms." Seems "compelling speech" is a terrible thing in Klippenstein's book - especially when it happens to him.<br />
<br />
Klippenstein, admittedly, "would not be the person" he is "without freedom of thought and expression," so where's his outrage at the legal suppressing of those freedoms - aka gag orders? And who would he be then, with his mouth legally taped shut?<br />
<br />
Klippenstein's made it clear he's all about defending "freedoms" as they apply to him, so I'd like to know what he thinks about reaching into the legal toolkit and pulling out the heavily-used duct tape - to suppress and kill those freedoms in others?<br />

The trust account of $40,000 is a very significant amount of money, especially to Ms Ernst – who is no longer able to work in her profession.<br />

I consulted the Law Society of Ontario’s Practice Management Guidelines for Client Service and Communication, Section 2.18 Withdrawal of Services, or Otherwise Ending the Engagement. There are many references to the Rules of Professional Conduct Section 3.7 which clearly describe the obligations of a lawyer. You do not appear to have followed most. Do you intend to do so in a timely fashion?<br />
<br />
While you claim to have minimized your office staff, it appears the physical office still exists, and you have not given up your accreditation as a lawyer in Ontario. It would therefore appear that you have obligations of some urgency to fulfill for Ms Ernst.<br />

I have checked at City Hall. There are no regulations against urinating outside in the municipality of Richelieu, Quebec. I feel there is only one thing for me to do, and that is to call the police. But with no laws broken, what can the police do? <br />

Pour les avertir de ma présence, je sonne une cloche. J’ai posé une affiche. J’ai demandé au propriétaire d’aviser ses employés du problème. Et ç<span style="background-color: white; color: #545454; font-family: "arial" , sans-serif; font-size: x-small;">à</span> continue. Par exemple, aujourd’hui, j’ai vu 3 hommes uriner pendant que je préparais mon dîner et je le mangeais. Pas très ragoûtant, je vous dirais. <br />

-Après avoir publié texte ci-haut, à la maison, je me suis rendue compte que des matériaux de construction avait été jetés sur mon terrain, et quand je suis allée les ramasser, je me suis rendue compte qu on avait déféqué entre 2 de mes cèdres. <br />
-J’ai appelé la police, puis le propriétaire de la maison qui se fait réparer à côté de chez moi.<br />
-Le propriétaire de la maison en réparation m’assure qu’il avait avisé les employés de ma demande de discrétion quand ils urinent dehors. <br />
-Le propriétaire de la maison en réparation me dit qu’il y a une toilette qui fonctionne dans la maison.<br />
-Le propriétaire de la maison en réparation me dit qu’il va aviser les employés encore une fois et les faire ramasser le tout.<br />
-Le policier qui se présente chez moi me dit qu’il n’y a pas grand chose à faire à moins d’avoir une photo ou un vidéo du geste illicite.<br />
-Dès la fin de la journée suivante, tout avait été ramassé.<br />

Conclusion: Une gang de jeunes hommes qui se mettent de connivence afin d’intimider une femme à la retraite qui vit seule, c’est loin d ’être édifiant! Près de 400 signataires réclament un plan d’urgence de protection de l’eau, en plus d’un meilleur soutien de la part du ministère de l’Environnement, du Développement durable et de la Lutte aux changements climatiques.<br />

La rivière Richelieu étant située en milieu majoritairement agricole, la présence de pesticides et d’herbicides, par exemple, est plutôt élevée. S’il existe des lois concernant la protection des bandes riveraines (afin de limiter la propagation de ces contaminants dans l’eau), elles ne sont pas toujours respectées.<br />
<br />
Cependant, les usines de filtration ne réussissent pas à éliminer tous les polluants, qui se retrouvent dans le système d’approvisionnement en eau potable de plusieurs municipalités. Au total, 41 municipalités tirent leur eau potable de la rivière.<br />
<br />
De plus, «la navigation de plaisance, en pleine croissance et très peu réglementée, accentue la pression sur les systèmes d’épuration», peut-on lire dans la pétition. Les déversements d’eaux usées dans la rivière Richelieu, de plus en plus nombreux, est aussi dénoncé par le document. En 2017, près de 3700 surverses ont été comptabilisées.<br />
