Preparing for the case that is sure to come



"In her mind, (Jessica) Ernst had carefully previewed the case before her. A powerful company, a pioneer in the fracking of unconventional resource plays, had clearly broken the law. The company had fracked into aquifers at Rosebud with impunity and then diverted water without a permit. Two provincial regulators had failed to investigate the law-breaking. Instead, they had conducted a farcical water investigation that included sampling water from wells with dirty equipment - tainted by gopher shit, no less. The regulators had also failed to follow their own enforcement rules. Rather than penalize Encana for fracking into groundwater, the EUB (Energy & Utilities Board) had attempted to intimidate and punish Ernst for comments she had made about the regulator's incompetence, both publicly and privately. In doing that, the EUB had infringed upon her right to freedom of expression as guaranteed by the Canadian Charter of Rights and Freedoms. The provincial government was covering up the methane contamination of water caused by the industry that had employed Ernst for nearly thirty years. She knew she would need one helluva lawyer."

"Jessica Ernst avait planifié soigneusement dans sa tête le procès qui l'attendait. Une compagnie puissante, une pionnière dans le fracking de la ressource non conventionnelle, avait clairement violé la loi. La compagnie avait fracturé hydrauliquement dans les nappes aquifères sous Rosebud avec impunité et ensuite redirigé l'eau sans un permis. Deux régulateurs provinciaux avait failli dans leur tâche d'enquêter les contrevenants. Au lieu de çà, ils avaient mené une enquête ridicule sur l'eau dont des prélèvements d'eau de puits avec de l'équipement souillé de merde d'écureuils terrestres. Les régulateurs n'avaient pas respecté leur propres règlements. Plutôt que de pénaliser Encana pour avoir fracturé dans de l'eau souterraine, le conseil EUB avait essayé d'intimider et punir Ernst pour avoir passé des commentaires qu'elle avait prononcés sur l'incompétence du régulateur publiquement et en privé. En faisant cela, le EUB avait porté atteinte à ses droits de liberté d'expression tels que garantis par la Charte canadienne des Droits et Libertés. Le gouvernement provincial camouflait de la contamination de l'eau avec du méthane causée par l'industrie qui avait donné du travail à Ernst pendant presque trente ans. Elle savait qu'elle aurait besoin d'un avocat du tonnerre."
