Le ministre Blanchet apaise les inquiétudes sur la fracturation hydraulique

QUÉBEC, le 5 juin 2013 /CNW Telbec/ - Le ministre du Développement durable, de l'Environnement, de la Faune et des Parcs, Yves-François Blanchet, a tenu à apaiser les inquiétudes concernant la technologie de fracturation hydraulique dont un aspect est traité dans le cadre du projet de règlement sur le prélèvement des eaux et leur protection (RPEP) qui fait présentement l'objet d'une consultation. En effet, un article publié sur quelques sites Web de médias nationaux affirmait ce matin que le gouvernement « allait de l'avant » avec la fracturation hydraulique.

« Le RPEP traite de tous les aspects de l'exploration et de l'exploitation d'hydrocarbures sous l'angle spécifique de la protection de nos ressources en eau potable. Il n'a pas pour objet l'encadrement général du recours à la technique de la fracturation hydraulique. Ce qu'on a lu est un glissement important quant au sens du règlement, a déclaré le ministre après la période de questions à l'Assemblée nationale. En cas de projet de fracturation hydraulique, rien ne permet d'ailleurs de présumer de la délivrance de permis par le ministère des Ressources naturelles ou de certificats d'autorisation par mon ministère, et encore moins de contournement des mécanismes d'évaluation environnementale. »

Le ministre a souligné que le projet de règlement ne modifie en rien les règles en vigueur mais qu'il les renforce et les bonifie. Ainsi, désormais, en plus de nécessiter un certificat d'autorisation, toute opération de fracturation et de forage d'exploration de pétrole de schiste devra être précédée d'une étude hydrogéologique dans un rayon de deux kilomètres du site potentiel. Selon les conclusions de cette étude, la zone de protection pourrait être étendue. Quant à la zone de protection minimale de 400 mètres de profondeur, le ministre a précisé que celle-ci se situe sous la nappe phréatique et qu'elle atteindra donc, de façon générale, un minimum de 600 mètres. Aux fins de compréhension, notons que 91,45 % des puits servant à l'alimentation en eau au Québec ont une profondeur inférieure à 100 mètres.

Le ministre a d'ailleurs tenu à souligner que les experts de son ministère avaient abondamment étudié la littérature scientifique sur le sujet avant de déterminer cette zone de protection. Ceux-ci ont notamment tenu compte des particularités du territoire québécois, du cadre réglementaire des autres provinces et des États voisins et de la littérature scientifique concernant les impacts de l'exploitation du pétrole et du gaz naturel.

« En ce qui concerne la situation particulière sur l'île d'Anticosti, j'ai fait savoir à plusieurs reprises qu'elle fera l'objet d'une évaluation environnementale spécifique. Nous en ferons connaître la teneur au moment opportun. Mais je tiens à rappeler qu'il n'y a actuellement aucun permis de forage à l'étude pour l'île d'Anticosti », a précisé le ministre Blanchet.

« Par ailleurs, le gouvernement du Parti Québécois a déposé un projet de loi décrétant un moratoire sur l'exploration et l'exploitation du gaz de schiste dans la vallée du Saint-Laurent, a rappelé le ministre. Or, les partis d'opposition font présentement obstacle à l'adoption de ce projet de loi », a fait observer le ministre.

« Notre gouvernement agit de manière concrète, responsable et rigoureuse en matière d'exploitation des ressources et de protection de l'environnement. Je respecte absolument l'opinion des groupes ou citoyens qui ne souhaitent pas que le Québec explore ou exploite ses ressources en hydrocarbures. Ce n'est cependant pas la position du gouvernement du Québec. Nous entendons toutefois faire preuve de fermeté et de rigueur dans l'application de normes environnementales exemplaires en vue d'encadrer de telles activités au Québec », a conclu le ministre.

Finalement, notons que le projet de règlement a fait l'objet d'une annonce publique le 15 mai dernier et qu'un communiqué de presse a été diffusé le même jour à ce sujet. Here's my translation of the Environment Minister's press release issued to appease preoccupations about fracking.

Minister Blanchet wants to appease concerns about fracking

Quebec, June 5 2013 - Environment Minister Yves-François Blanchet wants to appease concerns about the hydraulic fracturing technology of which aspects are mentioned in the regulation draft regarding water withdrawals and their protection subject of a consultation presently. Indeed, a reporting published on a few Websites of national medias said this morning that the government was going ahead with hydraulic fracturing.

"The draft regulation covers all aspects of exploration and exploitation of hydrocarbons with specifics on protecting our drinking water sources. It's aim is not to cover the general question of the hydraulic fracturing technique. What we have read is a serious deviation of the meaning of the regulation, said the Minister after question period at the National Assembly. When there is a project of hydraulic fracturing, there's no assuming that a permit would be issued by the Natural Resources Ministry or an authorization certificate by my ministry, and even less the bypassing of the environmental assessment mechanisms."

The Minister mentioned that the draft regulation does not modify the regulations in place right now but reinforces them and completes them. And so from now on, on top of needing an authorization certificate, all fracturing and extraction operation for shale oil exploration will be preceded by an hydro-geological study within a 2 kilometre perimeter of the potential site. Depending on the conclusions of said study, the protection zone could be extended. As for the minimal protection zone of 400 meters in depth, the minister pointed out that it would be beneath the groundwater table and would then be usually as deep at a minimum of 600 meters. To help understand this, let's point out that 91,45% of drinking water wells in Quebec are shallower than 100 meters.

The minister also wanted to point out that his ministry's experts had thoroughly studied the scientific literature on the subject before determining this protection zone. They had taken into account the particularities of the Quebec territory, of the regulation framework in the other provinces and neighbouring States and of the scientific literature regarding the impacts of oil and gas exploitation.

"As for the particular question of Anticosti Island, I often said that there would be a specific environmental assessment about it. We shall make the details known at the appropriate time. But I must remind you that there is no drilling permit being considered right now for Anticosti Island", had to say Minister Blanchet.

"Also, the Parti Québécois government tabled a bill to declare a moratorium on the exploration an exploitation of shale gas in the St. Lawrence Valley, said the minister. But the opposition parties are presenting obstacles to the adoption of this bill", says the minister.

"Our government acts in a real, responsible and rigorous way when it comes to the exploitation of the resources and protecting the environment. I absolutely respect the opinion of groups or citizens that do not wish that Quebec explores or extracts it's hydrocarbon resources. But it is not the position of the government of Quebec. We intend to be thorough and show firmness in the application of exemplary environmental standards to oversee such activities in Quebec", says the Minister.
